Why Your Business Needs an AI Policy
An AI acceptable use policy is as fundamental today as an internet acceptable use policy was in 2005.
If you have employees, you need an AI policy. Even if your company has 10 people. Even if you think nobody is using AI. They are. Research consistently shows that a majority of knowledge workers are already using generative AI tools, many without telling their employer.
Without a written policy, you have no standing to discipline misuse, no framework for evaluating new tools, and no documentation to show auditors or clients who ask how you handle AI and data privacy.

Data Classification Framework
Before you can write rules about AI use, your team needs a shared understanding of data sensitivity. This traffic-light system is the foundation:
SAFE: Any AI Tier
- ✓ Public company info
- ✓ Marketing drafts
- ✓ General research
- ✓ Open-source code
- ✓ Meeting agenda templates
CAUTION: Team Tier or Above
- ⚠ Internal process docs
- ⚠ Financial summaries (no PII)
- ⚠ Employee communications
- ⚠ Product roadmaps
- ⚠ Vendor evaluations
RESTRICTED: Enterprise + DPA Required
- ✗ Client PII/PHI
- ✗ Social security numbers
- ✗ Medical records
- ✗ Legal case files
- ✗ Financial statements with PII
- ✗ Trade secrets/IP
Most day-to-day AI use falls in the green zone. Marketing brainstorming, research, general writing help, public information lookups. All safe for any tier. The yellow and red zones are where policies matter, and where most shadow AI incidents happen.
AI Acceptable Use Policy Framework
Here's the complete structure. Each section covers what to include and why it matters.
1. Purpose and Scope
State the intent: this policy governs employee use of generative AI tools in all work contexts, including company devices, personal devices used for work, and any situation where company data is involved. Cover both approved tools and personal accounts. Be explicit that the policy applies to all employees, contractors, and temporary staff.
2. Approved AI Tools
List every AI tool the company has sanctioned, along with its tier and what it's approved for. For example:
- [Tool Name] Team, approved for general business use including yellow-zone data
- [Tool Name] Enterprise, approved for all data including red-zone with BAA (if applicable)
WARNING
Any tool not on this list is not approved. Period. Employees who want to use a new tool must request approval through your designated person or process. See our Provider Privacy Matrix for help selecting approved tools.
3. Data Classification and Handling
Reference the green/yellow/red framework above. For each zone, specify:
Green (Safe)
Any approved AI tool, including free tiers
- ✓ Public information and general research
- ✓ Marketing brainstorming and copywriting
- ✓ General writing help and editing
- ✓ Company-provided tools are still preferred
Yellow (Caution)
Team-tier or Enterprise-tier only
- ✓ Employee names and client names
- ✓ Internal processes and workflows
- ✓ Non-public financial data
- ✓ Proprietary business strategies
RED ZONE
Restricted data may only be used with Enterprise-tier tools that have specific compliance certifications (BAA for healthcare data, DPA for EU data). If no approved tool exists for red-zone data, AI may not be used with that data.
4. Prohibited Uses
Be explicit. Employees must never:
- Enter Social Security numbers, credit card numbers, or financial account numbers into any AI tool
- Upload patient health records, diagnoses, or treatment plans without a BAA-covered tool
- Paste complete client contracts, legal agreements, or NDAs into non-enterprise AI tools
- Use AI-generated content in client deliverables without human review and verification
- Share AI conversations containing company data via screenshots, links, or exports
- Use AI to make automated decisions about employment, credit, insurance, or other consequential outcomes without human oversight
- Bypass this policy by using personal devices or accounts with company data
5. Accountability and Human Oversight
AI is a tool, not a decision-maker. Every output needs a human owner.
Employees are responsible for:
- Verifying the accuracy of all AI-generated content before using it
- Taking ownership of decisions that incorporate AI-generated insights
- Disclosing to clients or stakeholders when AI has been used to generate deliverables (where required by contract or regulation)
- Reporting any suspected data exposure through AI tools to [designated person] immediately
6. Training Requirements
All employees must complete AI awareness training within [30 days] of hire and annually thereafter. Training covers:
- How AI data training works and why it matters
- The data classification framework
- How to use approved tools properly
- Recognizing and avoiding shadow AI risks
- Incident reporting procedures

7. Incident Response
If an employee realizes they've entered sensitive data into an unauthorized AI tool:
Stop using the tool immediately
Close the session and do not enter any additional data.
Document what data was entered and when
Note the tool used, what was pasted or uploaded, and the approximate time.
Report to IT within 24 hours
Contact your IT manager or designated person. Do not wait.
IT assesses and remediates
IT will assess the exposure, determine notification requirements, and take remediation steps.
Log for compliance records
The incident will be documented for audit and compliance purposes.

This is not a punitive process. It's a security process. The goal is to identify and contain exposure, not to punish people for honest mistakes. A culture where employees are afraid to report incidents is more dangerous than the incidents themselves.
8. Review Cadence
AI capabilities, pricing, and regulations change fast. This policy should be reviewed and updated at least quarterly by [designated person/team]. Reviews should cover:
- New AI tools or tier changes from approved vendors
- Changes to vendor data policies

- Incidents or near-misses since last review
- Employee feedback on policy practicality
Customizing for Your Industry
The framework above is meant to be adapted. Here's how to adjust it by industry:
- Healthcare: Add HIPAA-specific requirements. Reference your BAA requirements. Specify that no PHI enters any tool without Enterprise + BAA. See our HIPAA-Compliant AI guide.
- Legal: Add attorney-client privilege considerations. Specify that no privileged communications enter AI tools. Address AI use in legal research vs. client work product.
- Financial services: Add SOX compliance considerations. Address AI use with non-public financial information. Reference SEC guidance on AI in investment decisions.
- Marketing/Creative: More permissive on green-zone data. Address copyright and IP ownership of AI-generated content. Clarify disclosure requirements for AI-assisted content.
- Technology: Address source code classification (usually yellow or red). Specify rules for AI-assisted code generation. Cover open-source licensing implications.
